1. Acceptance of Terms

By accessing or using WorkRight ("the Platform"), operated by Kaptanz Space Private Limited, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. These terms apply to all users including company administrators, employees, and ICC members.

2. Description of Service

WorkRight provides a POSH (Prevention of Sexual Harassment) Act 2013 compliance platform including interactive training modules, completion certificates, complaint management with ICC workflow, policy generation, and annual report generation for Indian companies. The Platform is designed to help organizations comply with the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You must notify us immediately of any unauthorized access. Company administrators are responsible for managing employee accounts within their organization.

4. Training Content & Certificates

Training content is aligned with the POSH Act 2013 and the Supreme Court's Vishaka Guidelines 1997. However, WorkRight does not provide legal advice. Completion certificates are proof of training completion and are intended to support compliance documentation. They do not constitute legal certification or guarantee compliance. Organizations should consult qualified legal professionals for specific compliance requirements.

5. Complaint Management

The Platform provides tools for managing complaints as required under the POSH Act. All complaint data is treated as strictly confidential in accordance with Section 16 of the Act. The organization's Internal Complaints Committee (ICC) is responsible for conducting inquiries. WorkRight facilitates the process but does not participate in or influence complaint outcomes.

6. Subscription & Payments

Paid subscriptions are billed annually. All prices are exclusive of applicable GST (currently 18%). Payments are processed securely through Razorpay. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are available within 7 days of payment if no training has been completed by any employee. Upon cancellation, existing certificates remain valid and downloadable.

7. Data Ownership

Your organization retains ownership of all data uploaded to the Platform including employee information, complaint records, and generated documents. WorkRight does not access, sell, or share your data with third parties except as required to provide the service or comply with legal obligations.

8. Acceptable Use

You agree not to: (a) use the Platform for any unlawful purpose, (b) attempt to access other users' accounts or data, (c) file knowingly false complaints through the Platform, (d) reverse engineer or copy the Platform's content or code, (e) use the training content outside the Platform without written permission.

9. Limitation of Liability

WorkRight is provided "as is" without warranties of any kind. We are not liable for any legal consequences arising from your organization's compliance or non-compliance with the POSH Act. Our total liability shall not exceed the amount paid by you for the service in the 12 months preceding any claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance. We will notify registered users of material changes via email.
